Alabama Auction — Auction Disclaimers & Buyer Responsibilities
These provisions apply to personal-property auctions conducted through Alabama-Auction.com. “Alabama Auction” means the legal business identified as the auction operator in the applicable auction terms.
1. As is, where is — with all faults
EXCEPT FOR EXPRESS WARRANTIES SPECIFICALLY PROVIDED IN WRITING OR WARRANTIES THAT CANNOT LAWFULLY BE EXCLUDED, ALL ITEMS ARE SOLD “AS IS, WHERE IS,” WITH ALL EXISTING FAULTS. TO THE FULLEST EXTENT PERMITTED BY LAW, ALABAMA AUCTION AND THE SELLER DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
Items may require repairs, replacement parts, transportation, or substantial additional expense.
2. Inspect before bidding
Buyers are responsible for reviewing each listing, asking questions, and inspecting items during any advertised inspection period before bidding. Buyers who choose to bid without inspecting accept the risk of defects an inspection would reasonably reveal, subject to applicable law.
An inspection after winning does not create a trial period or a general right to cancel.
3. Descriptions, photographs & operating condition
Listings may contain information supplied by sellers or third parties. Photographs and videos may not show every defect or include every accessory pictured. Buyers should verify the included items, specifications, identification numbers, mileage, hours, and suitability for their intended use.
An item starting, moving, or operating during a demonstration does not establish its complete condition or guarantee future performance. Nothing in these terms excuses fraud or overrides an enforceable express warranty.
4. Completed sales & payment
Once an auction sale is completed and the buyer is determined under the applicable auction terms and law, the buyer must pay the winning bid, disclosed buyer’s premium, applicable taxes, and other disclosed charges by the stated deadline.
A change of mind, inability to obtain financing, or failure to inspect does not by itself cancel a completed purchase. Sales are final except for remedies expressly provided in writing or required by law.
5. Titles & road use
Buyers must review the title status and documents offered for each vehicle or titled item. Do not assume an item includes a transferable title, qualifies for registration, or is safe or legal for highway use unless expressly stated. Buyers are responsible for applicable registration, insurance, inspection, and transportation requirements.
6. Pickup, loading & transportation
Items will be released only after payment has cleared and release requirements are satisfied. Buyers must meet the published pickup deadline and arrange suitable transportation, personnel, and equipment.
Loading assistance is available only when expressly offered. Buyers and their carriers must follow site safety rules and are responsible for damage caused by their own acts or omissions.
7. Late pickup & default
Failure to pay or collect items as agreed may result in account suspension and lawful collection or resale remedies. Storage, handling, transportation, and other default charges apply only as disclosed in the accepted auction terms and permitted by law.
8. Online bidding
Internet connections, devices, and bidding systems can fail or experience delays. Submit bids early. Any extension, suspension, or rescheduling will be handled under the published auction procedures and applicable law.
9. Rights preserved
These terms do not exclude liability for fraud, intentional misconduct, or any liability or buyer remedy that cannot lawfully be excluded. Any unenforceable provision will apply only to the extent legally permitted.
